Probate Approvals for Minors and Estates

Abigail has worked with families for preparing court approved guardianships for disabled adults in the probate courts. The probate process can be difficult to navigate, but guardianships are sometimes necessary - whether it is limited or plenary guardianship for the individual's person and estate.

John Fleming presented the settlement of a minor’s injury claim to the court, for approval, based upon payment of all medical bills for the minor’s injury, and payment of a small amount for the pain and suffering damages for the minor. The court approved the settlement in order to resolve the claim against the Defendants.

Abigail has worked on behalf of insured and insurance companies to settle claims for minors and gain court approval of the settlement. Sometimes, the settlement is with the parents of the minor(s) directly, rather than a represented individual. Abigail has worked with pro se Plaintiffs to prepare documents, obtain proper signatures and approvals, and complete the court approval process without issue. The liens and payment process can often be difficult as well for pro se litigants, but our office has completed this process numerous times successfully.

Abigail facilitated the probate court approval process of a settlement for the benefit of a minor.  This case involved a motor vehicle accident where a minor individual sustained personal injuries.  The insurance company was able to reach a settlement agreement with the parent of the minor for the child’s injuries prior to any filed lawsuit.   Abigail opened an estate with the courts for the limited purpose of approving this settlement and appointing a guardian for the minor’s estate.  The probate approval process ensures that the court reviews the injuries of the minor, approves the settlement figures and that the funds are placed in an account until the child reaches majority. 

Abigail prepared documents for probate approval in Woodford County for an injured minor. Guardian Ad Litem was appointed. The Court approved the settlement and funds were kept in an interest-bearing account for the minor until the age of majority.
