Litigation Success

Fleming Law Office attorneys handled the defense of an insurance carrier in a declaratory action suit and Section 155 damages claim, following the insurer’s denial of a first-party fire damage claim. A section 155 claim potentially allows the insured to recover certain statutory penalties and attorney fees against the insurer. At issue in the case was the interpretation of a policy clause regarding the insured’s duty to maintain and service safety equipment. Although the trial court found the insurer owed coverage under the policy, the court held that a bona fide dispute existed as to the interpretation of the policy. The insurer was found not liable for Section 155 damages.
