Litigation Success

Fleming Law Office attorneys handled a personal injury automobile accident case where the plaintiff’s medical provider refused to testify and plaintiff was forced to voluntarily dismiss his case during pre-trial motions. The automobile accident involved a light touching of the vehicles, showing only light scratch damage. The plaintiff claimed to suffer soft-tissue complaints after the accident, and sought primary treatment with one physician. A defense motion was filed to bar the physician, due to credibility and licensure issues. The doctor failed to appear to testify live at trial and provided an affidavit in lieu of testimony. The judge granted the defendant’s motion to bar the affidavit, because the defense is afforded a right to cross-examine the doctor. In the moments before trial started, the plaintiff voluntarily dismissed his case.
