Examinations Under Oath
Lasalle County - House fire
Our office represented an insurance carrier and conducted Examinations Under Oath in claim arising from a house fire where the insured and his spouse were having an argument, gas can was involved, items were thrown toward the house, and the house fire began within minutes thereafter. Ultimately, the insured homeowner (one spouse only) pled guilty to arson, and the claim was denied.
Peoria County – Examination Under Oath (EUO) – Medical Payments
Abigail Fleming handled a medical payments arbitration arising out of a T-bone motor vehicle accident that occurred in Chillicothe, Illinois. The Petitioner claimed injuries of continued knee, ankle, and soft tissue neck and back pains for an extended period of time after release from care. After conducting the Examination Under Oath (EUO) and assessing the value of the case, Abigail was able to convince the Petitioner to drop the remainder of the claims prior to incurring arbitration costs.
Tazewell County, Illinois – Examination Under Oath (“EUO”) – House Fire
John P. Fleming investigated a claim involving a house fire at a home that the truck driver homeowner only lived in 2 days out of every month, and which the homeowner claimed he always intended to sell. The fire occurred when the truck driver was allegedly driving from Illinois to Texas, but it turned out that the truck driver admittedly tampered with his driving logs regarding locations and hours during the time of the fire. The truck drivers new “girlfriend” admittedly started the fire in a closet in the bedroom, during a day when she had extensive cell phone communication with the truck driver.
